BUYERS GUARANTEE FOR CURLY CALF SYNDROME
-
Each Cow Power consignor guarantees their
consignments to test negative to a diagnostic test within 6
months of when the diagnostic test is commercially available.
ANY CLAIMS MUST BE MADE WITHIN 6 MONTHS OF THE DIAGNOSTIC TEST
BEING AVAILABLE.
- Information on this
syndrome is available on the American Angus Association
website. Copies are available from the sale manager.
- If an animal tests as a
carrier, the buyer has the option for a full refund. Buyer is
responsible for trucking and management costs, plus the test
costs of a negative diagnostic test. Should the animal be
tested as a carrier, the costs of the diagnostic test will be
reimbursed by the seller plus the sale value of the animal if
the buyer wishes.
- If a bred female tests
negative, but the unborn calf she is carrying tests positive as
a carrier after birth, settlement will be reached using the
following formula: 75% of the sale price will be assigned
to the pregnant female and 25% to the unborn calf. A base price
of $750 (estimated feeder price) will be assigned to the calf,
and the buyer will be reimbursed the difference between the 25%
of sale price and the $750 base price. For example: For a
$5000 bred female, the unborn calf's value is $1250 (25%).
$1250-$750 base price= $500 refund for the calf.
- The buyer and seller
agree to fully and promptly comply with all rules of the
American Angus Association relating to genetic defects. This
guarantee is in addition to those Angus breed sale terms and
conditions.
- Seller offers a full
refund on carrier animals or mutually agreed upon replacement
animals. The return of the purchase price in connection with a
carrier animal will be deemed full satisfaction and settlement.
- Seller reserves the
right to retest a carrier animal at another qualified lab
approved by the American Angus Association that is accepted by
the buyer. Retests must be done within 45 days of notification
of the first test.
- This guarantee is
designed to protect both the buyer and the seller.
